1. Affirmative Representations
When a customer uses the Gualy recycling Service, he/she represents that:
(a) the information submitted is truthful and accurate;
(b) The customer contact information will be updated if it changes so that we can contact you;
(c) The customer is not violating any applicable law or regulation;
(d) The customer is over 18;
(e) The customer is the legal owner of any jewellry that is sent to us; and
(f) The customer is selling or is attempting to sell Jewelry on his own behalf and is not an agent or a representative of a third party. We reserve the right to request documentation and other proof of compliance with the requirements contained in this Section 1.
2. Shipping your Jewellery/other items to us
The customer is entirely responsible for sending his/her unwanted items to Gualy Recycling Service at his own cost and responsibility. The customer is responsible for any loss or damage that may occur during the shipping of the goods. Gualy will not be responsible and cannot be held liable for loss or damage of items shipped.
We reserve the right, in our sole discretion, to reject delivery of any envelope or package that appears to be damaged, opened or tampered with, and we will return these envelopes or packages to you. We will have no liability to any customer for returning envelopes or packages in this manner.
3. Jewellery Appraisal
3.1. Upon receipt of your jewellery/other items, we will weigh and assess the metal and its purity grade. The value we attribute is based solely on the weight of your jewellery and karat grade (purity) contained in your jewellery, not on its potential value if resold intact. The aim of this service is recycling metals (old jewels or other gold and silver items of our customers), doing our part to reduce waste and help the environment. We purchase jewellery for refining, not for resale. All pieces are weighted after we have taken out all the gemstones, zirconias or other materials. We do not return the gemstones. We do not value, recycle or reuse gemstones.
3.2. The value of customer items for recycling will be set in accordance with the price of the London Gold Fixing (here designated as “trade price”), taking into account the daily price established and published in international media, as well as in the web site http://www.lbma.org.uk/stats/currstat. Gualy Recycling Service values items at 85% of the trade price. The trade price is the daily price on the day that the customer jewels/other items arrive at Gualy designated address for this service.
3.3. The items are valued in Euro (EUR) or Pound Sterling (GBP), dependent on the country of origin of each customer.
4. Payment: Recycling Voucher
Gualy Recycling Vouchers are sent by e-mail together with an evaluation form , which contains the details concerning the weight and purity of the items received and their respective value. For each package (which may contain multiple jewels), one Recycling voucher will be issued.
Each Recycling voucher contains the value in EUR or GBP and also a unique code.
The Gualy Recycling vouchers are valid for 12 months from the date of delivery.
All issued Vouchers are exclusive of VAT as second hand items from customers are exempt from VAT.
Gualy makes no warranties, express or implied, with respect to Recycling vouchers, including, without limitation, any express or implied warranty of merchantability or fitness for a particular purpose except the warranty that the Recycling voucher will be sent to the recipient or to the purchaser. The email exchanges with Gualy occur by public data transfer net. Gualy cannot guarantee the continuous data communication and availability of its website and is not liable for any technical difficulties in connection with the internet whatsoever, including without limitation, technical disruptions or computer malfunctions.
5. Delivery Information and Requirements
We are not responsible for Gualy Recycling Vouchers that are undeliverable or not received due to the consumer’s failure to enter an accurate email address. Please check to make sure the email address is correct and contact Customer Service if you did not receive your Recycling Voucher.
6. Reasons for Failed Delivery
In the event that the recipient email address has been checked and confirmed, yet the on-line Recycling Voucher has still not been received, the following is a list of the most common reasons why delivery might have failed:
- - Spam filter blocked email or routed it to a bulk/spam folde;
- - Recipient's firewall blocked the emai;
- - Email inbox is over size limi;
- - Invalid email addres.
If your spam filter is blocking recyclingservice@gualy.com emails from getting to your inbox you will need to modify your email options so that recyclingservice@gualy.com emails are not considered spam. Below are two examples on how to modify your spam filters, for Yahoo and Hotmail, but the principle should be the same for all email service providers.

7. Redemption of a Recycling Voucher
The Recycling vouchers are only redeemable for merchandise at any Gualy on-line stores, in the designated currency. The Recycling vouchers cannot be returned or exchanged for cash. When a customer is shopping online in www.gualy.com, he/she will find an appropriate space in the Gualy shopping bag to introduce the recycling code, getting the amount of the Recycling Voucher discounted on the amount of his/her purchase.
8. Accepting/Rejecting the Recycling Voucher
Our calculation process is completely transparent, as we value at 85% of the metals “trade price”. Customers can check on the Gualy website the exact price we pay per each gram (based on the metals trade price of that day), before sending the items to us. Our fair and transparent process aims to guarantee that the customer gets no surprises with the value attributed in his Recycling voucher. If the customer does not contact us within 4 working days after receiving the Recycling Voucher, the items received will be sent to a third party for purification, and we will no longer be able to return it to you. We will not be responsible for any loss or damage of any kind if you do not contact us within this return period for the return of your old jewellry/other items.
In cases where customers contact us within the 4 working days after reception of the Voucher, not accepting the value received, Gualy will send all the items back. We will, at our sole discretion, choose the return carrier to send your jewels/items back, but the postage costs will be charged to you at the moment you receive your package. Gualy will not be responsible and cannot be held liable for loss or damage of items shipped.
9. Fraud, lost or stolen jewellery/other items for recycling
Upon receipt of your package with used jewellery/other items, we will send an e-mail confirmation. If during the period between the reception of your package and the emission of your Recycling voucher there occurs some damage, loss or theft regarding the items sent to us, Gualy is responsible and its liability will be limited to One Hundred Euro (€100). Gualy will issue a Recycling Voucher either in the value of the items estimated by the customer or a voucher of One Hundred Euros (€100), whichever is less. Gualy liability will be limited to One Hundred Euro (€100), per package, as set forth herein above.
10. Fraud, lost or stolen cards
Gualy redeems the online Recycling Vouchers when they are submitted without verifying the presenter’s authorization and authentication. Furthermore Gualy is not liable for any damages resulting from the Recycling voucher, including, without limitations, damages resulting from lost, stolen, misused, unused or destroyed (etc). of Recycling vouchers and Recycling Voucher codes. We reserve the right to refuse, cancel or hold for review Recycling Vouchers and orders for suspected fraud, for vouchers mistakenly issued in an incorrect denomination, or for other violations of Recycling Voucher policies.
Recycling Vouchers will not be replaced if lost or stolen without proper proof of purchase. Gualy is not obliged to refund a Recycling Voucher or a Recycling Voucher code. Risk of loss passes to the consumer upon electronic transmission of the Recycling Voucher to the consumer himself.
11. Additional conditions
Gualy Recycling Vouchers and their use on the www.gualy.com website are subject to Gualy’s actual general terms and conditions and data protection policy. In the event of inconsistencies with the general terms and conditions these terms and conditions supersede.
Gualy reserves the right to add, delete and/or modify any of these terms and conditions, at any time, at its sole discretion. These terms and conditions are applicable to the maximum extent permitted by law and specific terms and conditions are void where prohibited.
By using Gualy “Recycling Service” you confirm that you acknowledge and accept these terms and conditions.
